Proof reading and checking

We use all our best efforts to ensure that we deliver error-free copy however responsibility for proof reading lies with you. It is the sole responsibility of the client to review all material prior to production and to attest for its accuracy. Please check everything, in particular: spelling, colour, layout, contact details, document size and anything else relevant to the project. We will not be liable for production charges or legal liability related to any error in copy, edited or not. The client has final approval and responsibility for accuracy of materials. Where Transformer are not managing the print, we cannot be held liable for production charges for errors in finished art which has been previously checked and signed off by the client. We are also not liable for any costs where the printer amends the artwork themselves without consulting Transformer.

Website Specifications

Our websites are optimised to be satisfactorily rendered by the current (and one previous) versions of Internet Explorer, Mozilla Firefox and Safari browsers, viewed with Medium text size. They are optimised for a typical screen display and cannot be guaranteed to look right on every single computer, display, window size or browser as they are all different.

Search Engine Optimisation

We always endeavour to make a website in such a way as to attain a good ranking by search engines. However we cannot guarantee that any site will be indexed by Google and other search engines and directories in the way that the client prefers or wishes, or within any period of time as we have no control over the policies of such search engines.

Website Maintenance & Warranty Period

If any problems occur in the first 30 days after launching the site we will make any necessary changes to make the site function in the way described in the scope at our cost. Anything that was not part of the original scope will be chargeable – we can provide an estimate first if you wish.

After the 30 day period we will charge for maintenance. This can be done in one of two ways:

  1. A maintenance contract with a fixed monthly fee (fee to be discussed)
  2. Pay as you go at your standard design rate

 

We can discuss these options with you.

Chargeable maintenance includes anything required to enable the site to function in the way that it was intended – this could be upgrades to the coding to cope with changing software on host servers, troubleshooting, training, re-instating after server crashes or if the site is ‘hacked’, any additional content that you require us to add or any design changes requested.

Website Hosting

We can arrange hosting for our clients through a third party. However we cannot be held responsible for any loss of use of the website caused by that third party performing maintenance, upgrading software/hardware etc. In the event of the site not working for these reasons we will endeavor to fix these problems as fast as possible but it isn’t possible to guarantee how long it will take to diagnose and fix these problems. Please accept that we will use our best efforts to remedy any issues.

Copyright

The copyright for any creative work remains ours until it is paid for in full.

Problems

We try extremely hard to keep our clients happy. If you have a problem, in the first instance please raise it with your account manager. If this does not resolve the issue please contact Nigel Smith, the director.

GST

Our prices are GST exclusive.

Estimate period

Our prices are valid for 30 days from the Estimate date.

Deposits

We require a 50% deposit before beginning work. Deposits are applied to the next invoice.

Progress Payments

Projects which take longer than one month to complete may be invoiced for progress payments (between 50% and 100% of the remainder), for payment by no later than 20th of the following month, especially where we have already done a significant part of the work.

What does ‘estimate’ mean?

We make every endeavour to keep to our estimates and we try to estimate as accurately as possible. However it is not always possible to foresee every eventuality that may arise in a project therefore we reserve the right to charge at our standard rate for any extra hours incurred over and above the estimate if it becomes absolutely necessary. We will try to inform you of this and discuss the options before making any extra charges.

Meetings/briefing time

Unless otherwise stated in the Estimate above or any attached proposal we have allowed for a meeting (in Auckland) or briefing time by phone/email of up 90 minutes. Any additional briefing time required will be charged at the same rate as design work.

Timings

Much as we cherish you, you are not our only clients. We are also a family friendly company and we do not want our team to have to work all night or at the weekend. In order to keep everyone happy and our fees down it is very important that we are able to schedule our work well. We will work out a time line for your project with you and we do need you to stick to your side of the bargain in terms of delivering content and giving us feedback. If you don’t do this we will not be able to deliver on time. On very rare occasions this means a client decides to go to an alternative supplier. In these circumstances, where your delay has made it impossible for us to reasonably meet the deadline, deposits are non refundable.

We try to keep our estimates as low as possible and do not factor in having to employ freelancers or pay overtime to get work done. If you need something urgently we may need to add a premium to an estimate for this reason.

Amendments

Unless otherwise stated in the Estimate or any attached proposal we have allowed for one minor set of author’s text amendments. Any additional amendments will be charged at our standard design rate. Therefore we encourage you to give us proof-read text that is completely correct – if you then have to make amendments after we begin design then please give them to us all in one go.
